Short version: Use SaleSpot legally and respectfully. Don't abuse the service, post fake listings, or try to hack it. Pro subscriptions auto-renew and are managed by Apple/Google. We can suspend accounts that violate these terms.
1. Acceptance of Terms
By downloading, installing, or using the SaleSpot mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and SaleSpot ("we," "us," or "our").
2. Description of Service
SaleSpot is a mobile application that aggregates and displays information about garage sales, estate sales, farmers markets, and similar community sales events. The Service includes:
- Discovery of nearby sales events via map and list views
- Saving and favoriting events
- Push notification alerts for new sales
- Route planning for multiple stops (Pro feature)
- Custom sale alerts by category and radius (Pro feature)
3. Eligibility
You must be at least 13 years of age to use SaleSpot. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
4. User Accounts
To access certain features, you must create an account. You agree to:
- Provide accurate and complete registration information
- Keep your password confidential and not share your account
- Notify us immediately of any unauthorized account access
- Take responsibility for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
5. Acceptable Use
You agree to use SaleSpot only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates applicable local, national, or international laws
- Post false, misleading, or fraudulent sale listings
- Attempt to gain unauthorized access to any part of the Service or its systems
- Use automated scripts, bots, or scrapers to access or extract data from SaleSpot
- Reverse engineer, decompile, or disassemble the app
- Resell or commercially exploit SaleSpot's content without our written permission
- Harass, abuse, or harm other users
- Interfere with or disrupt the integrity or performance of the Service
- Circumvent subscription paywalls or attempt to access Pro features without a valid subscription
6. Content and Accuracy
SaleSpot aggregates sale listings from publicly available third-party sources (classified sites, community boards, etc.). We do not verify, endorse, or guarantee the accuracy, completeness, or legitimacy of any sale listing.
- Sale details (address, dates, items, prices) may change without notice
- We are not responsible for cancelled, moved, or misrepresented events
- Always confirm sale details directly with the seller before traveling
- SaleSpot is not a party to any transaction between buyers and sellers
7. SaleSpot Pro Subscriptions
Subscription Plans
SaleSpot offers a Pro subscription with two billing options:
- Monthly: $4.99 per month
- Annual: $29.99 per year (billed annually)
Free Trial
New Pro subscribers may receive a 7-day free trial. If you do not cancel before the trial ends, you will be charged for the subscription. Only one free trial per Apple ID or Google account.
Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Apple ID or Google account will be charged within 24 hours prior to the end of the current period.
Managing Your Subscription
- iOS: Go to Settings → [Your Name] → Subscriptions → SaleSpot
- Android: Go to Google Play → Profile → Payments & subscriptions → Subscriptions
Cancellation takes effect at the end of the current billing period. You retain Pro access until then.
Refunds
All subscription payments are processed by Apple or Google. Refund requests must be submitted directly to:
- Apple: reportaproblem.apple.com
- Google: Google Play Help
Price Changes
We reserve the right to change subscription pricing with 30 days advance notice. Continued use after price changes constitutes acceptance of new pricing.
8. Intellectual Property
SaleSpot and its original content, features, and functionality are owned by SaleSpot and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any portion of the Service without our express written consent.
9. Location Services
SaleSpot uses your device's location to provide nearby sale results and route planning. By granting location permission, you consent to this use as described in our Privacy Policy. You may revoke location access at any time in your device settings, but this will limit the Service's core functionality.
10. Third-Party Services and Links
The Service may contain links to third-party websites or services. SaleSpot has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party sites. We encourage you to review the privacy policies of any third-party sites you visit.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. We do not warrant the accuracy or completeness of any sale listing information.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SALESPOT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.
13. Indemnification
You agree to indemnify and hold harmless SaleSpot and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, violation of these Terms, or violation of any rights of a third party.
14. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or the integrity of the Service.
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
16. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify you via the app or by email, and update the "Last updated" date above. Continued use of the Service after changes constitutes acceptance of the new Terms.
